By accessing or using the Thrive platform at https://thrive.engagementfit.com (the “Platform”), you agree to comply with these Terms of Use (“Terms”). If you do not agree, please discontinue use immediately.
These Terms govern your use of the Platform and are supplemented by our Terms of Engagement, which outline specific contractual obligations for clients. In case of any conflict, the Terms of Engagement will prevail.
1. Introduction
1.1. Ownership: The Platform is owned and operated by My Pocket Coach Pty Ltd, trading as EngagementFit (“we,” “us,” or “our”).
1.2. Purpose: The Platform offers tools and services, including DRIVE Assessments, Talent Navigation, Engagement Tracker, and Team DNA, to enhance team dynamics, employee engagement, and talent alignment.
2. Acceptance of Terms
2.1. Agreement: By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
2.2. Modifications: We reserve the right to update these Terms. Changes will be effective upon posting on the Platform, and continued use constitutes acceptance of the revised Terms.
3. Services Offered
3.1. DRIVE Assessment: Provides insights into individual drives and their impact on behavior.
3.2. Talent Navigation: Assists in role mapping, generating match reports, and identifying coaching needs.
3.3. Engagement Tracker: Monitors employee engagement in real-time across five key areas.
3.4. Team DNA: Analyzes team dynamics and identifies opportunities for collaboration.
4. Registration and Account Management
4.1. Account Creation: Users must create an account and provide accurate and complete information.
4.2. Account Security: Users are responsible for maintaining the confidentiality of their credentials and for all activities under their account.
4.3. Account Termination: We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Platform.
5. Payment and Fees
5.1. Service Fees: Fees for services, including subscriptions and assessments, are outlined on the Platform and subject to change with 30 days’ notice.
5.2. Payment Methods: Payments are processed securely via Payfast or equivalent providers. Users are responsible for any applicable taxes or fees.
5.3. Refunds: Fees are non-refundable, except as required by law.
6. Intellectual Property
6.1. Ownership: All content, tools, and other materials on the Platform are the intellectual property of My Pocket Coach Pty Ltd.
6.2. License: Users are granted a limited, non-exclusive, revocable, non-assignable license to access and use the Platform for its intended purpose however, nothing contained on the Platform or in these Terms should be construed as granting any license or right to use any intellectual property without our prior written permission.
6.3. Restrictions: Unauthorized reproduction, distribution, or modification of content is strictly prohibited.
6.4. We reserve the right to make improvements or changes to the intellectual property, information, videos, graphics, and other materials on the Platform, or to suspend or terminate the Platform, at any time without notice; provided that any transactions or functions already concluded, will not be affected by such suspension or termination (as the case may be).
6.5. Prohibited Use with AI Tools:
The Licensee, Affiliate, Client, or User (as applicable) agrees and
acknowledges that all EngagementFit intellectual property, including but not
limited to the DRIVE assessment, assessment results, Drive names and
definitions, methodologies, reports, training materials, branding elements, and
related documentation (“EngagementFit IP”), is protected by copyright, trade
secret, and other applicable intellectual property laws.
Under no circumstances may any EngagementFit IP be input
into, used to train, or processed by any artificial intelligence (AI) system,
large language model (LLM), machine learning application, or similar automated
tool, whether public or private, for the purpose of creating, training,
enhancing, or generating new content, derivative tools, or any form of output.
This restriction includes, without limitation, prohibiting the use of
EngagementFit IP with services such as ChatGPT, Bard, Claude, Jasper,
Midjourney, DALL·E, or similar generative AI platforms.
Any such use will constitute an immediate material breach of this
Agreement and EngagementFit reserves the right to pursue all remedies available
under applicable intellectual property and contract laws, including injunctive
relief and damages.
7. Data Privacy and Security
7.1. Privacy Policy: Your use of the Platform is governed by our Privacy Policy, which complies with GDPR and POPIA.
7.2. User Consent: By using the Platform, you consent to the collection, processing, and storage of your data as described in the Privacy Policy.
7.3. Data Use: Data collected during assessments is used solely to generate reports and improve services.
8. Prohibited Conduct
Users shall not:
8.1. Use the Platform for illegal or unauthorized purposes.
8.2. Interfere with or disrupt the Platform’s functionality including through, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means or defacing, altering or interfering with the front end ‘look and feel’ of the Platform or the underlying software code.
8.3. Share or distribute proprietary content without prior authorization.
8.4. Post, upload, replicate or transmit any abusive content on the Platform that is or could reasonably be considered to be threatening, harassing, defamatory, abusive, racist, sexist, discriminatory, in breach of confidence, in breach of privacy or restrict any user in any way from properly using the Platform.
